Answers to frequently asked questions about buying a house.

Certainly. Our independent mortgage advisors are based in-house and work directly with you and your buying agent. This allows us to make better decisions together and act quickly when the situation demands it.

Once the seller and buyer agree on the core elements—including the price, delivery date, resolutive conditions, and any agreements regarding movable property—the selling NVM broker records these agreements in the purchase agreement. The sale is only concluded once both parties have signed the purchase agreement.

Resolutive conditions are an important point of consideration. If you wish to have these included in the purchase agreement, you must include them in the negotiations. As a buyer, you do not automatically receive a resolutive condition. The buyer and seller must agree on additional arrangements and resolutive conditions before the purchase agreement is drafted.

The sale is only concluded at the moment the purchase agreement has been signed by both parties. This stems from the Immovable Property Purchase Act and is known as the written requirement. An agreement made orally or confirmed by email is therefore not sufficient. As soon as the seller and the buyer have signed the purchase agreement and the buyer (and potentially the notary) has received a copy of the agreement, the statutory cooling-off period comes into effect for the private buyer (see question 11). Within this period, you as the buyer may still withdraw from the purchase. After this period, the sale is final, unless the resolutive conditions apply.

Yes. In fact, we consider it essential. Only by thoroughly inspecting a property ourselves can we accurately assess its state of maintenance, structural risks, and realistic market value.

Yes, this is permitted. Sometimes there are so many interested parties offering or approaching the asking price that it is difficult to determine who the best buyer is. At that point, the seller – on the advice of their estate agent – may decide to change the bidding procedure to, for example, a ‘sealed bid procedure’. In this procedure, all bidders are given an equal opportunity to submit an offer. The estate agent must, of course, first honor any previously made commitments or agreements before the procedure is changed.

Yes, that is permitted. A negotiation does not necessarily lead to a sale. Furthermore, the seller will likely want to know if there is further interest. It is also permissible to negotiate with multiple interested buyers simultaneously. An NVM estate agent must clearly inform all parties if this is the case. Often, the listing NVM agent will inform interested parties that an offer has already been made or that negotiations are ongoing. The NVM agent does not disclose the amount of the bids, as this could incite overbidding.

That is a frequently asked question. Our answer is always clear: because you want someone by your side who provides honest advice, identifies risks, knows the market, and negotiates sharply on your behalf. No, the seller is not obliged to sell the property to you. The Supreme Court has ruled that the asking price should be seen as an invitation to make an offer. Even if you bid the asking price, the seller can decide whether or not to accept your offer, or (via their agent) make a counteroffer.

The statutory three-day cooling-off period means that you, as the buyer, can dissolve the purchase without providing any reasons. The three-day cooling-off period begins as soon as a copy of the signed purchase agreement has been handed to the buyer. The cooling-off period may last longer than three days if it ends on a Saturday, Sunday, or a public holiday. Specific rules have been established for this. The NVM estate agent can indicate exactly when the cooling-off period expires.
