When are you allowed to rent out your home temporarily?
Since July 1, 2024, temporary rental contracts are only permitted in specific situations. Fortunately, there are exceptions. For instance, under certain conditions, you can rent out your property temporarily if it is for sale, when you move abroad temporarily, or if you are moving in with a partner. For a property that is for sale, rental can be arranged via the Vacancy Act, for example. If you are moving abroad temporarily, a diplomatic clause may provide a solution. A special regulation also exists for those moving in together.
Which option is most suitable depends on your situation and the applicable conditions.
Request permission first
Before you offer your property for rent, it is important to check whether you require permission from:
- Your mortgage provider – rental is not permitted with every mortgage.
- Your municipality – a permit may be required.
- Your insurer – renting out the property may have consequences for your insurance.
- The Owners’ Association (VvE) – additional rules may apply in the case of an apartment.
The rental price, the content of the rental agreement, and the tax implications also require careful consideration.
